Court cases in Bangladesh can last years, and NRBs cannot fly back for every hearing. Fortunately, civil cases can largely be handled through an advocate, and virtual court technology now exists, but there are situations where personal presence is unavoidable, especially in criminal cases. In civil suits, a party can appear by a recognised agent (Order 3 of the Code of Civil Procedure 1908) or by an advocate. You sign a vakalatnama authorising the advocate and, if needed, a Power of Attorney for a family member to sign documents and receive notices (see PoA guide). For evidence, you may later need to testify in person or by video. Ask your advocate early when your testimony is likely.

Since 2020, the law allows courts to hold hearings through video conferencing and to take evidence remotely in suitable cases. Prepare a stable internet connection, a quiet room and ID documents when the time comes.

In criminal cases, the accused generally has to appear before the court to apply for bail; a bail petition filed by an advocate for an absent accused is usually not accepted. If there is a warrant or case against you in Bangladesh, speak to an advocate before you travel. You may need to surrender and apply for bail at the right court. Complaints and FIRs can often be fought and quashed in the High Court Division through a writ or criminal miscellaneous case, which an advocate can file without your presence.
